While using the Ocean 5 website, we may ask you to provide certain PII that can be used to identify and/or contact you. PII may include, but is not limited to:

Usage Data 

Usage Data is collected automatically when using the Ocean 5 website. 

Usage Data may include information such as your device’s Internet Protocol (IP) address, browser type, browser version, the pages of the website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 

When you access the Ocean 5 website by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. 

We may also collect information that your browser sends whenever you visit the Ocean 5 website or when you access the website by or through a mobile device.

Use of Your Personal Data

Ocean 5 may use PII for the following purposes:

  • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our service, products, services, marketing and your experience. 

We may share your personal information in the following situations: 

  • With Service Providers: We may share your PII with service providers to monitor and analyze the use of our website services. 
  • For business transfers: We may share or transfer your PII in connection with, or during negotiations of, any merger or sale of Ocean 5’s assets, financing, or acquisition of all or a portion to another company. 
  • With Affiliates: We may share your PII with affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include any subsidiaries, joint venture partners or other companies that Ocean 5 controls or that are under common control with Ocean 5.

Retention of Your Personal Data

Ocean 5 will retain your PII only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your PII to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

Ocean 5 will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of A-TEK, Inc.’s website, or Ocean 5 is legally obligated to retain this data for longer time periods.

Your information, including personal data, is processed at the Ocean 5 operating offices and in any other places where the parties involved in the processing are located. Ocean 5 will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information. 

Delete Your Personal Data 

You have the right to delete or request that Ocean 5 assist in deleting the personal data that Ocean 5 has collected about you. 

Please note, however, that Ocean 5 may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Under certain circumstances, Ocean 5 may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

  • Protect and defend the rights or property of Ocean 5

Security of Your Personal Data

The security of your personal data is important to Ocean 5., but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While Ocean 5 strives to use advanced means to protect your personal data, we cannot guarantee its absolute security. 

Children’s Privacy

The Ocean 5 website does not address anyone under the age of 13. We do not knowingly collect PII from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided Ocean 5 with personal data, please contact us. If Ocean 5 becomes aware that we have collected personal data from anyone under the age of 13 without verification of parental consent, Ocean 5 will take steps to remove that information from our records. 

If Ocean 5 needs to rely on consent as a legal basis for processing your information and your country requires consent from a parent, Ocean 5 may require your parent’s consent before we collect and use that information. 

Ocean 5 does not market to children under 13. 

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy. According to CalOPPA we agree to the following: 

  • Users can visit our site anonymously. 
  • Once this Privacy Policy is created, we will add a link to it on our home page or as a minimum on the first significant page after entering our website. 
  • Our Privacy Policy link includes the word ‘Privacy’ and can be easily be found on the page specified above. 
  • Users will be notified of any privacy policy changes on our Privacy Policy Page. 
  • Users are able to change their personal information by emailing us.
  • We honor “do not track signals” and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place. 
  • It’s also important to note that we do not allow third-party behavioral tracking.

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. 

We collect your email address in order to: 

  • Send information, respond to inquiries, and/or other requests or questions. 
  • Process orders and to send information and updates pertaining to orders. 
  • We may also send you additional information related to your product and/or service. 
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred. 

To be in accordance with CAN-SPAM we agree to the following: 

  • NOT use false or misleading subjects or email addresses. 
  • Identify the message as an advertisement in some reasonable way. 
  • Include the physical address of our business or site headquarters. 
  • Monitor third-party email marketing services for compliance, if one is used. 
  • Honor opt-out/unsubscribe requests quickly. 
  • Allow users to unsubscribe by using the link at the bottom of each email.

Links to Other Websites

Ocean 5 website may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We advise you to review the Privacy Policy of every site you visit. 

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Changes to this Privacy Policy

Ocean 5 may update its Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page, including the “Last updated” date at the bottom of this Privacy Policy.
